Filing for Divorce in Brazoria County as a Military Family
Texas requires at least six months of state residency and 90 days of county residency before filing for divorce. Those standards apply to military families just as they do to civilian households. A service member who has designated Texas as their home of record qualifies as a Texas domiciliary regardless of current duty station, which means filing in Texas remains an option even when physically stationed elsewhere.
A spouse living in Alvin or elsewhere in Brazoria County can file for divorce here even if the service member is deployed or stationed out of state. Filing in the wrong jurisdiction, however, can delay proceedings and create complications for dividing military retirement benefits. Brazoria County family cases are heard in the 300th District Court and the 461st District Court, both located at the Brazoria County Courthouse in Angleton.
Child Custody & Support When a Parent Is on Active Duty
Texas courts resolve custody disputes using the best interests of the child standard. Active-duty status doesn’t automatically reduce a service member’s parental rights, but deployment and permanent change of station orders create real practical challenges that a parenting plan must address.
A strong parenting plan for a military family covers temporary custody transfers during deployment, communication between the deployed parent and the children, and how the regular schedule resumes when the service member returns. Child support calculations for service members factor in base pay, allowances, and other military pay components, not base pay alone.
When a military parent holds sole custody, a family care plan may also be required. Because SCRA protections extend to custody modification proceedings, a deployed service member has time to respond before any modification order takes effect.
